This policy applies to nearbybathremodelers.com and to any other website, landing page or form that links to this policy (together, the "Site"). It applies to information we collect through the Site, and to information we collect when you contact us by phone, email or text message in connection with a request you submitted through the Site.

This policy does not apply to the practices of the independent remodeling professionals, contractor networks, manufacturers, dealers or other marketing partners who receive your information. Once your information has been shared with those parties, their own privacy policies govern how they handle it. We do not control, and are not responsible for, their practices. If you want to know how a particular partner treats your information, contact that partner directly or review the privacy policy linked from our Marketing Partners page.

This Site is intended for residents of the United States only. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local law. We do not represent that the Site or our practices comply with the data protection laws of any jurisdiction outside the United States.

Most of the information we hold about you is information you give us directly, by completing the estimate request form on this Site. The form is a single page and asks about your project and how to reach you. Depending on the version of the form you see, we may collect the following categories of information:

• Project details — the type of bathroom project you are considering (for example a full remodel, a shower remodel, a tub replacement, a tub-to-shower conversion, a walk-in shower, tile or flooring work, a vanity replacement or a fixture upgrade), the specific areas of the bathroom involved, the number of bathrooms in the property, and how soon you would like the work done.
• Property information — the street address, city, state and ZIP code of the property where the work would be performed, the type of property (for example single family, multi-family, or condominium or townhome), and whether you own the property.
• Contact information — your first and last name, telephone number and email address.
• Anything else you choose to tell us — for example additional notes about your project, or the content of an email, text message or phone call with us.
• Your consent record — whether you checked the consent box, the exact text of the disclosure you agreed to, and the date and time you submitted the form. See the section on consent documentation below.

When you visit the Site, certain information is collected automatically by our servers, by our hosting and analytics providers, and by the compliance technologies described below. This happens whether or not you submit the form. The information collected automatically is largely technical and is used to operate the Site, keep it secure, understand how it is performing, and evidence how a submission was made.

• Device and browser information — your browser type and version, operating system, device type, screen size, and language settings.
• Network information — your Internet Protocol (IP) address and information derived from it, such as an approximate city, state and ZIP code. IP-derived location is approximate and is not GPS data.
• User agent string — the full identifier your browser sends with each request, which we store with a lead record as part of the submission evidence.
• Usage information — the pages you viewed on the Site, the order in which you viewed them, the date and time of each request, how long you stayed, how far you scrolled, which form fields you interacted with, and whether you completed or abandoned the form.
• Referral information — the page or advertisement that brought you to the Site, and the specific landing page on which you arrived.

We and our service providers use cookies and similar technologies — including browser local storage, session storage, pixels, tags and software development kits embedded in the Site — to operate the Site and to understand and improve how it is used. A cookie is a small text file placed on your device by a website; similar technologies achieve comparable results by other means.

The technologies we use fall into a small number of categories. Strictly necessary technologies are required for the Site to function and cannot be switched off in our systems — they support things like security, load balancing, fraud prevention and preserving your form answers if a page reloads. Performance and analytics technologies help us count visits and traffic sources so that we can measure and improve the Site. Advertising and attribution technologies are set by us or by advertising platforms to measure the performance of campaigns and, where applicable, to deliver advertising that may be relevant to you.

We capture these parameters when you arrive and, if you submit the form, we store them with your submission. The attribution values we may capture and store include the standard UTM parameters (utm_source, utm_medium, utm_campaign, utm_term and utm_content), advertising platform click identifiers such as gclid (Google), fbclid (Meta), msclkid (Microsoft) and equivalent identifiers used by other platforms, any internal campaign, publisher or sub-identifier a partner appends to the link, the referring web address that sent you to the Site, and the exact landing page address on which you arrived.

Attribution values are about the advertisement, not about you personally — but because we store them next to your form submission, they become associated with you in our records and are treated as part of your information under this policy. We may share attribution values with the advertising platforms and lead-management providers that need them in order to reconcile and report on campaign performance.

If you want to prevent attribution parameters from being captured, you can navigate to this Site directly by typing the address into your browser rather than following an advertisement, although we may still record the fact that no referring source was present.

We use analytics services to understand how visitors use the Site in aggregate — how many people arrive, which pages they view, how far they scroll, where they leave, how many begin the form and how many complete it, and how these figures differ by traffic source and device. This information tells us which parts of the Site are confusing or slow and where to invest in improvements.

Analytics providers act as our service providers and process information on our behalf and under our instructions. Depending on the configuration in place at the time of your visit, an analytics provider may set its own cookies or identifiers, may receive your IP address (in full or truncated), and may combine the data it collects here with data it collects from other websites that use the same service. We configure analytics to limit the collection of directly identifying information wherever the provider makes that possible.

Analytics data is used for measurement and product improvement. We do not use analytics data alone to decide who is contacted about a project; that is determined by the form you submit and the consent you give.

Because the professionals and partners who receive your request will contact you by telephone, text message and email, both we and they need a reliable, independent record of the consent you gave and of the page on which you gave it. We use two industry-standard services for this purpose, and they are active on the pages of this Site that contain the estimate request form. Their scripts run in your browser while you are on the form page.

If you check the consent box and submit the estimate request form, you give your prior express written consent for us and for the marketing partners identified on our Marketing Partners page to contact you at the telephone number and email address you provided. That consent covers contact by live agent, by automatic telephone dialing system, by artificial or pre-recorded voice, by SMS or MMS text message and by email, about bathroom remodeling and related home improvement products and services.

Consent is not a condition of any purchase. You may request an estimate by telephoning us instead, and you may decline to consent and simply browse the Site. Message and data rates may apply to text messages, and message frequency varies. Calls and messages may be made to the number you provided even if that number is listed on a federal or state do-not-call registry, because your consent is an exception to those registrations; revoking consent, as described below, removes that exception.

The exact text of the disclosure you agreed to is displayed next to the consent box at the moment you submit, and the list of parties your consent applies to is the list published on our Marketing Partners page at that moment. That list changes from time to time. The version in effect when you submitted is the version your consent covers, and it is preserved in the consent record described in the previous section.

You can revoke your consent at any time, in any reasonable manner, and the mechanics for doing so are set out in the opt-out section below. Revocation stops future marketing contact; it does not undo contact that has already occurred and does not by itself delete the records we are required to keep.

We use the information described in this policy for the following purposes, each of which is directly connected to operating a lead-generation service:

• To match your request with independent remodeling professionals and partners whose service area, product range and capacity appear to fit the project you described.
• To transmit your request to those professionals and partners so that they can contact you, and to transmit the accompanying consent record so that they can verify your consent.
• To contact you ourselves — by telephone, text message or email — about the request you submitted, including to confirm details, to reach you if a submission was incomplete, and to follow up on your project.
• To validate submissions: to check that a telephone number is formatted and reachable, that an address resolves, and that a submission was made by a person rather than by an automated script.
• To detect, investigate and prevent fraudulent, duplicate, abusive or unlawful submissions and to protect the security and integrity of the Site.
• To measure and improve advertising performance, to reconcile and pay advertising partners, and to decide where to spend advertising budget.
• To measure and improve the Site itself — its speed, clarity, accessibility and conversion performance.
• To create and retain records evidencing consent, and to respond to complaints, regulatory inquiries, subpoenas and legal claims.
• To comply with applicable law and with our contractual obligations to the partners who receive leads from us.

Sharing your information is the core function of this Site, and you should assume that a request you submit will be shared. We share information as follows.

Some state privacy laws define terms such as "sale" and "sharing for cross-context behavioural advertising" broadly. Under those definitions, our disclosure of the information you submit to marketing partners in exchange for consideration, and our use of advertising and analytics technologies on the Site, may constitute a sale or a sharing of personal information. We describe the practice here so that you can evaluate it on the facts rather than on the label.

You can opt out of that sharing and of marketing contact at any time. The mechanics differ depending on the channel:

• Text messages — reply STOP to any text message you receive from us, and reply HELP for assistance. Opting out of texts from us does not automatically opt you out of texts from a partner who received your information; reply STOP to that partner's messages as well.
• Email — use the unsubscribe link in the footer of any marketing email, or write to us at the address below and ask to be unsubscribed.
• Telephone calls — tell the caller that you wish to be placed on their internal do-not-call list, and they are required to honour that request. You may also write to us and we will suppress your number in our systems.
• All channels at once, and opt-out of sale or sharing — send a request to privacy@nearbybathremodelers.com with the telephone number, email address and property address you submitted, and state that you are opting out of the sale or sharing of your personal information and of all marketing contact. You may also write to us at the postal address in the contact section.

We keep information for as long as we need it for the purposes described in this policy, and then for as long as we are required or permitted to keep it by law. In practice this means different retention periods for different categories of information.

Lead records — the contact and project details you submitted, together with the attribution values and the technical record of the submission — are retained for the period needed to deliver and support the request, to reconcile payment with advertising and partner platforms, and to defend against any claim arising from the contact you received. Consent records, including the TrustedForm certificate identifier and the Jornaya LeadiD token, are retained for at least as long as the limitation period applicable to claims under the telemarketing laws that the consent relates to, because a record that expires before the claim does is of no use to anyone.

Suppression and opt-out records are retained indefinitely. This is deliberate: the only reliable way to ensure we do not contact you again is to keep a record that you asked not to be contacted.

Analytics and advertising information is retained according to the settings and default periods of the relevant provider, which are generally shorter. Server logs are retained for a limited operational period and then deleted or overwritten.

Specific retention periods are still being finalised and must be confirmed by counsel before launch. Where information is no longer needed, we delete it or de-identify it in a manner designed to prevent re-identification.

We maintain administrative, technical and physical safeguards designed to protect information against unauthorised access, disclosure, alteration and destruction. These include encryption of traffic between your browser and our servers, encryption of stored data where our providers support it, access controls that limit internal access to those who need it, rate limiting and abuse detection on our form endpoints, and contractual security obligations imposed on the service providers who process information for us.

No method of transmission over the internet and no method of electronic storage is completely secure. We cannot and do not guarantee the absolute security of information, and you transmit information to us at your own risk. If we become aware of a security incident affecting your information, we will notify you and the relevant authorities where and as required by applicable law.

You can help by using a current browser, by not sending sensitive information such as financial account or government identification numbers through the form — we never ask for these and have no use for them — and by telling us promptly if you believe your information has been misused.

This Site is directed to adult homeowners and is not intended for children. We do not knowingly collect personal information from anyone under the age of sixteen, and no one under sixteen may use this Site or submit the estimate request form. We do not knowingly sell or share the personal information of anyone under sixteen.

If you believe that a person under sixteen has submitted information through this Site, please contact us at privacy@nearbybathremodelers.com with enough detail to locate the record. We will delete the information promptly and suppress the contact details so that no further marketing contact is attempted.

Several states have enacted comprehensive privacy laws that give residents rights over their personal information. The rights available to you, the exceptions that apply, the deadlines we must meet and whether you may appeal a decision all depend on the state in which you reside and on whether the law of that state applies to us. Some browsers offer a "Do Not Track" setting that transmits a signal to the websites you visit. There is no common industry or legal standard for what a website must do in response to that signal, and no consensus on what it means. Because of that, this Site does not currently respond to Do Not Track signals.

This is distinct from a state-recognised opt-out preference signal, which some state privacy laws do require us to honour as a valid opt-out of sale or sharing. Where such a signal is transmitted by your browser and the applicable law requires it, we will treat it as an opt-out request for that browser and device. If you want a durable, account-level opt-out that is not limited to one browser, send us a request as described in the opt-out section.

We provide those links for transparency and convenience. We do not control those websites, we are not responsible for their content or their privacy practices, and the inclusion of a link is not an endorsement.

When you leave this Site, this Privacy Policy stops applying and the policy of the site you have gone to takes over. We encourage you to read the privacy policy of any website you visit before providing information to it.

We may update this Privacy Policy from time to time to reflect changes in our practices, our partner list, the technologies we use, or applicable law. When we do, we will revise the "Last updated" date at the top of this page and post the updated policy here.

If we make a material change — for example, a change in the categories of parties with whom we share information, or in the purposes for which we use it — we will take additional steps to bring the change to your attention where required by law, which may include notifying you at the email address you provided. Your continued use of the Site after an updated policy is posted constitutes acceptance of that update.

The consent you gave applies to the disclosure text and partner list in effect at the time you gave it. A change to this policy does not retroactively expand a consent you already gave.
